It was in a Switch box with random styrofoam pieces thrown in. There were scratches in the left thumbstick, plus grunge on the ZL and ZR buttons. When I contacted the seller they asserted that the item was 'New' and disputed the pics I sent. They even accused me of wanting a refund because I 'got dirt on it' in the whopping 1 hour I'd had it. Had to have Ebay step in to make things right.
