When I sent the seller pictures of the issues, they didn't apologize, so I think it's clear they knew it was a used and damaged item. And once they received the item back, I had to get Ebay involved to get refund. I would still advise buyers to be cautious of this seller, as there were multiple defects in the chair that could not have been missed, and the seller lacks communication skills and is not quick to issue a refund, even after a case has been opened on eBay.
